Construction Site Erosion Control and Inspections

The Ohio EPA has classified the City of Reynoldsburg as a Phase II community in a “Rapidly Developing Watershed”. As such we are required to pay particular attention to controlling storm water runoff resulting from new construction (including redevelopment or rebuilding of existing properties). In order to assist builders and developers in complying with the new pollution control requirements we are providing this web page. City erosion control inspectors will conduct frequent inspections of all eligible construction sites. They will look for the proper installation and maintenance of erosion and pollution controls. The Ohio Department of Natural Resources publication Rainwater and Land Development 2nd edition will be used as the “Standard” for erosion control practices except where EPA standards are more stringent. A report will be prepared from each inspection and a copy will be provided to the Operator.

The Ohio EPA Construction Site Inspection Checklist provided on this web page is representative of the items that City erosion control inspectors check each time they inspect a construction site. Please note that the inspection frequency of once per week and within 24 hours after every rainfall of 0.5" or greater applies to the inspections that the Operator of each site is required, by the Ohio EPA, to perform. The inspections performed by City inspectors may not be counted towards satisfying these requirements.

There are a few additional requirements that are not included in the Ohio EPA Construction Site Inspection Checklist:

1. A copy of the SWP3 (see Ohio EPA website) must be submitted to the City of Reynoldsburg as a portion of the required Erosion Control Plan.

2. A second, updated copy must be maintained on the construction site at all times.

3. Copies of the mandatory self-inspection reports must be made available for review by City inspectors upon request.

4. In the event that a developer has sold parcels from a larger eligible site, the original Operator shall remain responsible for all portions of the SWP3 until the new owner has received approval of a NOI, by the Ohio EPA for that parcel and a NOT has been received by the original Operator

5. If the entire development has been "permanently stabilized" as defined in Ohio EPA Permit OHC000002, then the area of land being disturbed at one time will be used to determine the requirement for additional inspections.

6. The operator agrees that employees of the City of Reynoldsburg have permission to enter a Site at any time (except where a demonstrable safety issue temporarily prevents such access).

7. The operator must notify the City of Reynoldsburg Storm Water Pollution Control Office at least 48 hours prior to the commencement of disturbance of any new land areas.

DEFINITIONS

MS4: The Municipal Separate Storm Sewer System as defined by NPDES Permit OHQ1000000

NOI: Notice of Intent as defined by Ohio EPA Permit OHC000002

NOT: Notice of Termination as defined by Ohio EPA Permit OHC000002

Operator: The person (or company) having day-to-day control over a construction site as defined by OHC000002 Part VII.O

Site: An area of construction activity where one or more acres will be disturbed and meeting the other conditions described in OHC000002 and controlled by a single Operator or possessing a separate SWP3. Individual lots do not need to be contiguous to be considered to be part of a single Site.


SWP3: Storm Water Pollution Prevention Plan is the formalized plan describing the facilities and procedures that will be used by an Operator to prevent erosion or any other form of pollution from escaping from a construction site.
